Welcome to KindClerk. We respect your privacy and are committed to protecting your personal data. This Privacy Policy explains how we collect, use, and share information about you when you use our website, services, and interactions with our AI agents on WhatsApp, Facebook Messenger, and Instagram.

2. Information We Collect

We collect the following information:

  • Account Information: Name, email address, password, and organizational details when you register for an account.
  • Customer Conversations: Messages exchanged with a business through KindClerk on integrated channels, including WhatsApp, Facebook Messenger, and Instagram. This can include names, phone numbers, usernames or platform account identifiers provided by the channel, message content and metadata, and images, voice notes, documents, locations, or contact cards customers send.
  • Knowledge Base Data: Documents, FAQs, and URLs a business uploads so its AI agents can answer questions.
  • Connected Services: When a business connects another service (for example an online store, calendar, CRM, spreadsheet, or payment account), the information needed to answer its customers, such as products, orders, bookings, leads, and payment status.
  • Notifications: If you turn on alerts, the browser push subscription for your device.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our AI services and platform.
  • Process and respond to end-user inquiries on the business's behalf, including turning voice notes into text so they can be answered.
  • Personalize the AI interactions based on the business's brand voice, rules, and knowledge base.
  • Communicate with you regarding updates, security alerts, and support.

4. Meta Messaging Data Processing

When a business connects WhatsApp, Facebook Messenger, or Instagram to KindClerk, we receive and process the channel and account information needed to provide the integration. This may include business, Page, or Instagram account identifiers; customer names, usernames, phone numbers or platform identifiers supplied by Meta; messages and message metadata; and any media or attachments customers send. We use this information to display conversations and help the business respond to its customers. The business decides how its customers' conversations are used; we act as a data processor for those conversations and handle Meta data in accordance with Meta's applicable platform terms. We do not use end-user message data from these Meta messaging integrations to train generalized AI models outside the business's tenant.

5. Data Sharing and Service Providers

We do not sell your personal data. We share information only with the service providers that run KindClerk for us, and only what they need:

  • Supabase: database, file storage, and sign-in.
  • DigitalOcean: servers that run the KindClerk app.
  • OpenAI: generating AI replies and transcribing voice notes.
  • Meta: sending and receiving messages through WhatsApp, Facebook Messenger, and Instagram integrations.
  • Stripe: subscriptions and, if a business turns it on, card payments for its orders.
  • Resend: sending account and notification emails.

Services a business connects itself (such as its store, calendar, or CRM) receive the information the business asks KindClerk to send them.

6. Data Retention

We keep a business's data while its account is active. When a business closes its account, or when a business or a customer asks us to delete data, we delete it as described on our Data Deletion page. Some records may be kept longer where the law requires it.

7. Data Security

We implement reasonable technical and organizational measures to protect your personal data against unauthorized access, alteration, disclosure, or destruction. Each business's data is kept separate from every other business's. Sensitive credentials, such as Meta access tokens, are stored encrypted.

8. Your Rights

Depending on your location, you may have the right to access, correct, delete, or restrict the processing of your personal data. To delete data, follow the steps on our Data Deletion page; for anything else, contact us.
